1. These Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) govern the use of the activity bar called Zagrywki (hereinafter referred to as “Zagrywki”), located in Wrocław, at ul. Śliczna 7/16, 50-566 Wrocław, https://zagrywki/wroclaw/kontakt/, e-mail: info@wro.zagrywki.pl.
2. Zagrywki is managed by ABSOLUT sp. z o.o. with its registered office in Wrocław at ul. Śliczna 7/16, 50-566 Wrocław, tel. 71 77 33331, registered in the National Court Register in the register of entrepreneurs under KRS number 0000794136, entered in the REGON register under number 383921453, with NIP number 8992865723, hereinafter referred to as the Organizer.
3. All persons using Zagrywki (hereinafter referred to as “Users”) are required to read these Terms and Conditions. Entering the Zagrywki premises is tantamount to the User's acceptance of the Terms and Conditions.
4. In order to use the activities available at Zagrywki, you must have a valid admission ticket (ticket types and prices are available at the ticket offices and on the website www.zagrywki.pl).
5. The User acknowledges that during their stay at Zagrywki, they must strictly follow the instructions of the staff.
6. Staying at Zagrywki may require compliance with the provisions of other regulations, the content of which the User is required to read. The regulations referred to in the previous sentence concern:
a) the organization of events;
b) the use of cloakrooms;
c) the organization of children's birthday parties;
d) Bacardi martinis;
e) gift cards.
7. The following are prohibited on the premises of Zagrywki:
a) consuming food and beverages purchased outside the premises of Zagrywki,
b) bringing in and using intoxicants or psychotropic substances,
c) bringing weapons, explosives, pyrotechnics, or other
items that threaten the safety of Users,
d) entering rooms marked as service rooms,
e) aggressive, provocative, or otherwise threatening behavior towards other Users.
8. Users are required to show security personnel, at their request,
the contents of their clothing and luggage brought into Zagrywek.
9. The premises of Zagrywki are monitored by CCTV cameras. The images are recorded to ensure the safety of persons present on the premises of Zagrywki, while respecting their personal rights. Detailed information can be found in the Privacy Policy. Streaming, recording live coverage, and any other commercial use without prior marketing consent is prohibited. Recording for personal use is permitted provided that it does not violate the law or good manners. Zagrywki staff have the right to warn or ask to leave any person who records or streams in violation of the Terms and Conditions.
10. Persons staying at Zagrywki consent to the free use and dissemination of their image, recorded during their stay at Zagrywki, for the Organizer's marketing purposes. The consent is granted for an indefinite period and without territorial restrictions for the Organizer and is granted in the scope of all known fields of exploitation, including, in particular, use and exploitation on the Internet, including social media such as Facebook and Instagram, public display and sharing, recording, reproduction, and publication in any form and by any means, including on copies of leaflets, posters, etc. The Organizer ensures that the image of Users will not be used in a ridiculous, undignified, scandalous, compromising, or defamatory manner, nor for the purpose of promoting violence, hatred, discrimination, pornography, or drugs. By accepting these Terms and Conditions, Users waive their right to verify and/or approve materials containing their image.
Age
11. From 6:00 p.m., only adults are allowed on the premises of Zagrywki.
12. The organizer reserves the right to verify the User's age on the basis of an identity document. The Organizer emphasizes that it does not verify age based on: student ID cards, school ID cards, scans of documents, photos of documents, screenshots of documents, health cards on mobile phones, consent from a legal guardian, COVID passports, etc. Acceptable documents include: ID card, passport, driver's license, mObywatel, sailing card, residence card, resident card. Failure to meet the above requirements may result in refusal of entry or removal from the Zagrywki premises and non-realization of tickets at the risk and expense of the User. In such a case, the Organizer shall not refund the cost of tickets to the User.
13. For Beer Pong, age is verified on the basis of an identity document. Minors are not allowed to purchase alcohol.
14. Subject to paragraph 11, children up to and including 13 years of age may only participate in
activities at Zagrywki under the supervision of an adult who must remain on the premises of Zagrywki.
Responsibility
15. The Organizer does not provide childcare or supervision of young people.
16. The Organizer is not responsible for damage or destruction of items belonging to persons present on the premises of Zagrywki, except for damage caused by the Organizer.
17. The Organizer shall not be liable for any material loss or damage to items lost or left at Zagrywki or in its vicinity. Items lost or left at Zagrywki, if found by an employee of the Organizer or handed in by a third party to the reception desk, can be collected from the Zagrywki reception desk within 7 working days.
18. Persons use the activities at Zagrywki at their own risk. The Organizer shall not be liable for any damage to participants, including injuries, bodily harm, and their consequences, except for damage caused by the Organizer's fault.
19. In particular, the Organizer is not liable for any damage resulting from the improper use of the Zagrywki infrastructure, contrary to the instructions and recommendations of the staff, or due to the sole fault of the person using the activity.
20. The Organizer's employees have the right to ask a person whose behavior threatens their safety or the safety of other persons at Zagrywki to leave or refuse them entry to the premises.
21. In the event of a large number of people on the premises, the Organizer's employees may give priority to persons who have a valid reservation. Users who have not been admitted to Zagrywki in the situation referred to in the previous sentence are not entitled to any claims in this respect.
Ticket sales
22. The Organizer sells admission tickets to Zagrywki online at www.zagrywki.pl, where website users can place their orders. It is also possible to purchase tickets on the basis of a separate agreement or event regulations. These Regulations constitute, in the scope of services provided electronically consisting in the sale of tickets, the regulations for the provision of electronic services referred to in Article 8(1)(1) of the Act of July 18, 2002 on the provision of electronic services.
23. The functionality of the website www.zagrywki.pl enabling the purchase of tickets is an electronic service
which is voluntary and one-off, and the contract for its provision is concluded at the moment of starting to fill in the relevant form and ends at the moment of sending the order confirmation referred to in section 29 of these Terms and Conditions or of abandoning the form.
24. The person ordering the ticket and paying the fee purchases the right to participate in the activity at Zagrywki within the time specified on the ticket. The Organizer does not extend the duration of the activity in the event of the User's late arrival, regardless of the reason for the delay. The Organizer reserves the right to refuse the User access to the activity if the delay prevents them from participating in the activity within the time specified on the ticket.
25. When placing an order via the website, the user is required to select the date and time of entry, the type and number of tickets, the method of payment for the tickets, and to read and accept the Terms and Conditions, which is a condition for the order to be processed.
26. After placing an order, the user will receive an email message that the order
has been received by the System (ORDER CONFIRMATION).
27. The purchase price of the ticket is binding for the organizer and the buyer at the time the buyer places an order for the purchase of a given ticket.
28. The organizer reserves the right to change: ticket prices, ticket types. The above right does not affect the performance of contracts and orders placed before the date of entry into force of such changes.
29. One person may purchase any number of available tickets at a time for
the use of activities in Zagrywki that are on sale.
30. The number of tickets purchased cannot be increased unless the Organizer decides otherwise. The maximum number of additional tickets after the Organizer's consent is: 2.
31. The Organizer is not responsible for failure to place an order or deliver an order confirmation, inability to pay the price
due to an incorrect or inaccurate address provided by the Customer, Internet connection problems, or other circumstances beyond the Organizer's control.
32. Tickets are non-refundable for both online and in-store purchases
at Zagrywki. By way of an individual decision, but no later than 24 hours before the planned reservation, the Service Provider may, after consultation with the Customer, provide a discount code or change the date of the event/ticket.
Pursuant to Article 38(12) of the Consumer Rights Act of May 30, 2014 the purchaser of an admission ticket is not entitled to withdraw from a distance contract, as this right does not apply to consumers in relation to contracts for services related to leisure, entertainment, or sporting events if the contract specifies the date or period of service provision.
33. Complaints regarding electronic payments are handled by PayU. The user sends the complaint to the mailing address of Zagrywek, which forwards it to PayU. The complaint should contain the following information: name and surname, date, number, and amount of the transaction. PayU undertakes to provide full and comprehensive complaint handling.
34. In cases other than those mentioned in point 33, complaints are handled by the organizer within 14 days of receiving the complaint at the organizer's mailing address.
35. Credit card and e-transfer transactions are settled through PayU. PayU is responsible for handling complaints related to electronic payments.
36. The Organizer issues and sends electronic invoices, guaranteeing their authenticity and integrity. In accordance with the Act of March 11, 2004, on Goods and Services Tax (Journal of Laws of 2004, No. 54, item 535, as amended), an electronic invoice has exactly the same legal force as its paper counterpart.
37. The Organizer declares its readiness to resolve disputes through settlement, including the pursuit of claims through out-of-court ADR (Alternative Dispute Resolution). In such a case, please submit your complaints via the website:

Disputes between the Organizer and a customer who is not a consumer will be
settled by the court having jurisdiction over the Organizer's registered office.
38. The Organizer informs that the public nature of the Internet and the use of services
provided electronically may involve the risk of unauthorized persons obtaining and
modifying data and infecting the User's ICT system with unwanted, malicious software.
The basic potential risks associated with the use of the Internet include: The basic potential risks associated with the use of the Internet include:
a) malware;
b) applications or scripts that have harmful, criminal, or malicious effects on the User's ICT system, in particular viruses;
c) spyware;
d) programs that track the activities of Website users and collect information about
the User;
e) spam and unwanted and unsolicited electronic messages sent simultaneously to multiple recipients, often containing advertising content;
f) phishing for confidential personal information (e.g., passwords) by impersonating a trustworthy
person or institution.
39. In order to avoid the above threats, users of the www.zagrywki.pl website should
equip their computers and other electronic devices used to connect to the Internet with antivirus software. Such software should be kept up to date. Protection against threats related to the use of electronic services by Users is also provided by:
a) an enabled firewall;
b) updating all software, in particular the operating system installed on end devices;
c) not opening email attachments of unknown origin;
d) reading application installation windows and their licenses;
e) data transmission encryption;
f) using original systems and applications from legal sources.
40. In matters not covered by these Terms and Conditions, the relevant provisions of Polish law shall apply.
Amendments to the Terms and Conditions
Amendments to the Regulations
41. The Organizer reserves the right to amend the Regulations for important reasons, such as:
-the need to adapt the Regulations to legal provisions that have a direct impact on the Regulations and result in the need to modify the Regulations in order to comply with the law;
-the need to adapt the Terms and Conditions to the recommendations, orders, rulings, decisions,
interpretations, guidelines, or decisions of competent public authorities;
-the need to adapt the Terms and Conditions to the expansion or change of functionality of
Zagrywki, including the introduction of new services provided by Zagrywki
-a change in the technical conditions for the provision of services;
-the need to remove ambiguities, errors, or typographical mistakes that may
occur in the Terms and Conditions;
-changes to contact details, names, identification numbers, email addresses,
or links included in the Terms and Conditions;
-counteracting abuse and improving customer service quality;
42. The Organizer will announce changes to the Terms and Conditions via a message on the website
43. Changes to the Terms and Conditions will take effect no earlier than 7 days after the date on which
we announce such changes.
44. Changes to the Terms and Conditions will not affect orders already placed if you place them
before these changes come into effect – in this case, we will process them according to
the existing rules.
Personal data

46. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as “GDPR”).
47. Personal data is processed for the following purposes:
a – performance of a contract or taking steps at the request of the data subject prior to entering into a contract (legal basis: Article 6(1)(b) of the GDPR),
b – handling inquiries related to the provision of services (Article 6(1)(f) of the GDPR),
c – handling complaints and claims (Article 6(1)(b) of the GDPR),
d – storing documentation for the purposes of establishing, investigating, or resolving claims (Article 6(1)(f) of the GDPR).
48. Providing data is voluntary, but necessary to use the service.
49. The scope of required data includes: first and last name, email address, and telephone number. This data is processed for the purpose of identification or subsequent verification.
50. The controller does not transfer, sell, or lend the collected data. The recipients of the data may only be authorized employees or associates of the controller who provide services related to the processing or archiving of statements.
51. Personal data is processed for the period required to establish,
pursue, or defend legal claims. Detailed information can be found in the
Privacy Policy.
52. With regard to accounts created at the booking stage, personal data is
processed until the account is deleted. After deleting the account, the Organizer has the right to
process only those data that are necessary to establish, pursue, or defend legal claims, or where data retention is required due to tax regulations.
53. Every data subject has the right to access their personal data, rectify it, delete it, or restrict its processing, including the right to object to its processing, as well as the right to transfer data and lodge a complaint with a supervisory authority.
Token activities
54. Tokens can be purchased on site at Zagrywki. They are a contractual means of payment and are used in activities whose outcome depends solely on skill. One token is equivalent to PLN 6. Tokens have no expiry date.
55. Token activities are not a game of chance, gambling, betting, or any other form of gambling within the meaning of the Gambling Act of November 19, 2009. The organizer has the right to disable token activities at any time (e.g., due to a malfunction, exclusive reservation of a given level, etc.).
56. Purchased tokens cannot be exchanged for cash in whole or in part under any circumstances, are non-refundable, and cannot be exchanged for other products offered by Zagrywki. Subject to paragraph 55 of these Terms and Conditions, tokens are not a means of payment and cannot be used to make purchases at Zagrywki or anywhere else.
Final provisions
1. The publisher reserves the right to amend the Terms and Conditions. Each
document is marked with the date from which its provisions are effective.
2. In the event of an amendment to the Terms and Conditions during the execution of an order, the provisions in force on the date of commencement of the order shall apply.
3. In matters not covered by the Terms and Conditions, the relevant provisions of Polish law and/or the provisions applicable to the consumer's place of residence or the terms of the agreement between the parties shall apply.

4. In the event of a change and/or invalidation as a result of a final court ruling of

6. Any disputes between the Publisher and a Customer who is not a consumer shall be
settled by the court having jurisdiction over the Publisher's registered office. and higher – an accidental or natural (elemental) event over which the Publisher has no control, in particular fire, explosion, power failure, earthquake, flood, cloudburst, riots, pandemic, actions of civil or military authorities, war, acts of terrorism (including cyberterrorism), cyberattacks (e.g., DDOS), actions and/or omissions of telecommunications network operators, other random events.
