Rules and regulations for organizing events at Zagrywki
effective from July 10, 2023
GENERAL PROVISIONS
1 These rules and regulations set out the terms and conditions for providing services consisting of organizing events at Zagrywki (Rules and Regulations) for the Administrator's customers.
2 The Administrator is ABSOLUT sp. z o.o. with its registered office in Wrocław at ul. Śliczna 7/16, 50-566 Wrocław, tel. 71 77 33331, registered in the National Court Register in the register of entrepreneurs under KRS number 0000794136, entered in the REGON register under number 383921453, with NIP number 8992865723 (“Administrator”).
3 A customer may be either a natural person who is a consumer within the meaning of the law, or a natural person conducting business activity, or a legal person.
4 The site rules set out the rules for persons using Zagrywki. The content is available at the URL: https://zagrywki.pl/regulamin/ and on site. All persons using Zagrywki are obliged to comply with it.
5 Personal data is processed in accordance with the Zagrywki Privacy Policy available at the URL: https://zagrywki.pl/polityka-prywatnosci/
6 Force majeure is understood as an accidental or natural (elemental) event over which the Administrator has no control, in particular fire, explosion, power failure, earthquake, flood, cloudburst, riots, pandemic, sanitary restrictions imposed by the government, actions of civil or military authorities, war, acts of terrorism (including cyberterrorism), cyberattacks (e.g., DDOS), actions and/or omissions of ICT network operators.
RESERVATIONS
7 Event reservations can be made electronically. The Customer specifies the date, number of guests, activities, and payment method. A summary of the reservation is included in the event scenario, which is sent to the Customer for approval. Making the payment constitutes the Customer's confirmation of the terms and conditions contained in the event scenario and acceptance of the Terms and Conditions, and thus confirms the reservation of the event by the Administrator.
8 The date of the event binding for the Customer and the Administrator (the Parties) is the date specified on the invoice/in the event scenario. Settlement is based on the selected attractions and the declared number of people. An exception is an increase in the number of people on the day of the event (if space allows).
PAYMENT
9 Payment can be made electronically via PayU S.A. with its registered office in Poznań, 60-166 Poznań, at ul. Grunwaldzka 186, entered in the register of entrepreneurs kept by the District Court Poznań - Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register under number 0000274399, with NIP number: 779-23-08-495, with a share capital of PLN 4,944,000.00 paid in full, a domestic payment institution within the meaning of the Act of August 19, 2011 on payment services, entered in the register of payment services under number IP1/2012 (PayU). The Polish Financial Supervision Authority supervises PayU's activities in the field of payment services. Alternatively, payment can be made by bank transfer on the basis of an invoice.
10 The payment link is active for a specified period of time. Failure to make the payment within the validity period of the link or within the period specified on the invoice will result in the cancellation of the reservation, unless the Customer and the Administrator agree otherwise.
ODWOŁANIE/PRZENIESIENIE REZERWACJI
11 Administrator zastrzega, że w przypadku wystąpienia siły wyższej ma prawo zaproponować zmianę terminu, warunków lub anulować rezerwację i zwrócić środki w terminie 180 dni.
12 Klient nie może odwołać rezerwacji. Na podstawie art. 38 pkt 12 ustawy o prawach konsumenta z 30 maja 2014 r. konsumentowi nie przysługuje prawo odstąpienia od umowy zawartej na odległość, gdyż prawo to nie przysługuje konsumentowi w odniesieniu do umów usług związanych z wypoczynkiem, wydarzeniami rozrywkowymi lub sportowymi, jeżeli w umowie oznaczono dzień lub okres świadczenia usługi.
13 Klient nie może zmienić terminu potwierdzonej rezerwacji, chyba że Strony ustalą inaczej.
OPEN BAR
14 W razie niedostępności wybranej pozycji w pakiecie open baru Administrator ma prawo zapewnić zamiennik.
15 W ostatniej godzinie open bar nie jest wydawany alkohol na butelki.
16 Niezależnie od tego kiedy grupa gości przyjdzie open bar jest dostępny w godzinach określonych w szablonie imprezy.
17 Pierwsza osoba, która przyjdzie po odbiór opasek uprawniających do korzystania z open baru jest zobowiązana rozdać je w ramach grupy.
18 Nie wolno odstępować opaski osobom spoza imprezy. Administrator ma prawo takiej osoby nie obsługiwać.
19 Możliwe jest zwiększenie liczby osób w dniu wydarzenia po akceptacji Administratora.
20 Płatność za dodatkowe osoby i atrakcje odbywa się na miejscu.
COMPLAINTS
21 Please submit complaints electronically to the following email address: info@wro.zagrywki.pl.
22 Please provide a detailed description of the irregularity (including, for example, the time and place of occurrence and any proposed resolution).
23 Complaints will be reviewed as soon as possible, no later than 14 days.
24 The date of receipt of the complaint by the Administrator is considered the date of filing a complaint.
FURTHER PROVISIONS
25 The Client agrees to cover any damage or destruction caused by the Client's guests during the event on the Zagrywki premises. Any damage will be assessed by the Administrator based on a damage report. The Client is obligated to cover the costs of repairing the damage or destruction in the amount indicated on the relevant invoice, determined based on the valuation provided in the report mentioned above. 26 In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law and/or the provisions of consumer law applicable to the place of residence or the terms of the agreement concluded between the Parties shall apply.
27 In the event of any change and/or invalidation of any provision of these Terms and Conditions by a final court decision, the remaining provisions shall remain in effect.
28 The Administrator declares its willingness to resolve disputes amicably, including seeking redress through out-of-court ADR (Alternative Dispute Resolution) procedures. 29 Any disputes between the Administrator and a Customer who is not a consumer will be resolved by the court having jurisdiction over the Administrator's registered office.
